Copyright Infringement & DMCA

Vessel Digital, LLC respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we have adopted the following policy toward copyright infringement:

Notice of Infringement. If you believe that any content on the Site infringes your copyright, please provide our Designated Agent (contact details below) a written notice containing:

Counter-Notice. If you believe material was removed or disabled by mistake, you may submit a counter-notice containing:

3. A statement under penalty of perjury that you have a good-faith belief the material was removed in error. 
4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for your address.

Repeat Infringers. We will terminate accounts of repeat infringers in appropriate circumstances.

Disclaimers of Warranty

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. Vessel Digital, LLC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Vessel Digital, LLC's total liability arising out of or related to these Terms or your use of the Site shall not exceed the total amounts you have paid Vessel Digital, LLC in the past 12 months, or $100 if you have made no payments. Indemnification

You agree to indemnify and hold harmless Vessel Digital, LLC, its affiliates, and their officers, directors, and employees from any claim, loss, liability, or expense (including legal fees) arising from your breach of these Terms or your use of the Site.

Termination

We may suspend or terminate your account and access to the Site at any time, with or without cause, by notice to you. Upon termination, your license ends and you must cease all use of the Site.

Governing Laws & Disputes

These Terms are governed by the laws of New York, USA, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state or federal courts located in Monroe County, NY for any disputes arising under these Terms.

Changes to These Terms

We may modify these Terms at any time. Material changes will be effective 30 days after posting, with the “Effective Date” updated. Your continued use of the Site constitutes acceptance of the revised Terms.
